Please read these terms of use carefully before you start to use the site. By using our site, you indicate that you accept these terms of use and that you agree to abide by them. If ‘you(your)’ the user do not agree to these terms of use, please refrain from using our site.

The materials contained on our site are provided for general information purposes only and do not claim to be or constitute legal or other professional advice and shall not be relied upon as such.

We do not accept any responsibility for any loss which may arise from accessing or reliance on the information on this site and to the fullest extent permitted by English law, we exclude all liability for loss or damages direct or indirect arising from use of this site.

www.tustains.co.uk is a site operated by Tustains Ltd ("We"); we are a private limited company registered in England and Wales under registration number 383883. Our registered office is 89 Regent Street Leamington Spa CV32 4NT. Our VAT number is 307299643.

We are members of the Company of Master Jewellery and the National Association of goldsmiths.

Delivery

Tustains Ltd offer delivery to the United Kingdom (including the outer British Isles) and Northern Ireland addresses only. We cannot deliver to BFPO addresses or the Republic of Ireland.

We make every effort to deliver goods within our stated time scales, however delays are occasionally unavoidable due to unforeseen factors. Tustains Ltd shall be under no liability for any delay or failure to deliver the products within estimated timescales.

Risk of loss and damage of products passes to you on the date when the products are delivered.

Returns

As a customer it is your responsibility to ensure you are happy with all relevant details before placing an order. We will normally accept a return within 14 days in line with the consumer Contracts regulations 2014.

providing that the item is returned new and unused and in its original packaging and with any accompanying documentation such as diamonds certificates etc. New and unused means there are no scratches, marks, blemishes on the item, there are no signs of wear on the product and the product must not be altered in any way.

If an item you have purchased from is damaged or faulty please return it within 30 days of the purchase date for an exchange or refund.  

The item is your responsibility until it has reached us. We recommend that you send the item using a recorded delivery service that insures you for the full value of the item. Shipping costs will not be refunded.

Due to the nature of the items we sell it is necessary to specially make or order Items to fulfil a size requirement or stone size. In these cases the Items are non returnable unless faulty as they are none standards and therefore cannot be resold. This complies with the Consumer Protection (Distance Selling) Regulations 2000. If this applies to an item you are ordering it will be made clear during the order stage.

This does not affect your rights stated in the customer rights act 2015.

Prices and Payment

Our advertised prices include VAT.

We process your payment at the time we receive your order, once we have verified your card details and checked that goods are available to despatch. Goods are subject to availability. In the event that we are unable to despatch the goods within an acceptable time frame, we will inform you as soon as possible. Should you not be happy with any changes we will offer a full refund where you have already paid for the goods.

The price you pay is the price shown on the website at the time we receive your order. Whilst we make every effort to ensure that prices on our website are correct, errors can occur. If we discover an error in the price of goods you have ordered we will inform you of this fact as soon as possible. You will be given the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you we will treat the order as cancelled. If you cancel and you have already paid for the goods, you will receive a full refund.

Accessing our site

Access to our site is permitted on a temporary basis, and we reserve the right to withdraw or amend the service we provide on our site without notice (see below). We will not be liable if for any reason our site is unavailable at any time or for any period.

Intellectual property rights

We are the owner or the licensee of all intellectual property rights in our site, and in the material published on it. Those works are protected by copyright laws and treaties around the world. All such rights are reserved.

You may print off one copy, and may download extracts, of any page(s) from our site for your personal reference and you may draw the attention of others within your organisation to material posted on our site. 

You must not modify the paper or digital copies of any materials you have printed off or downloaded in any way, and you must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text.

Our status (and that of any identified contributors) as the authors of material on our site must always be acknowledged.

You must not use any part of the materials on our site for commercial purposes without obtaining a licence to do so from us or our licensors.

If you print off, copy or download any part of our site in breach of these terms of use, your right to use our site will cease immediately and you must, at our option, return or destroy any copies of the materials you have made.

Our site changes regularly

We aim to update our site regularly, and may change the content at any time. If the need arises, we may suspend access to our site, or close it indefinitely. Any of the material on our site may be out of date at any given time, and we are under no obligation to update such material.

Our liability

The material displayed on our site is provided without any guarantees, conditions or warranties as to its accuracy. To the extent permitted by law, we, and third parties connected to us hereby expressly exclude:

  5. Tustains reserve the right to decline any order, where in its opinion, a discount code is invalid for the order being placed.

Watch Winder Promotion.
To be eligible for this promotion your purchase must include a watch of a greater value than £1500 which has not been discounted, purchased through finance or being sold as pre-owned. Watch winder must be returned in pristine condition if watch is returned for a refund or its value may be deducted from the refund.
